                                                                                        RENTAL AGREEMENT 

                                                                                                                                                                                                                                                                 

 This rental agreement, dated________________ between EL CANTIL CONDOMINIUMS, INC. and TENANT______________________________________________

  for rental of condominium Unit #4C SUR located at Avenue Melgar, between 13 and 15 Avenue, San Miguel, Cozumel, Quintana Roo, Mexico, beginning on

 __________________________3:00 PM and ending on ________________________12:00 PM (______nights) for the amount of  $______________________

 US DOLLARS, plus 12% tax $___________________US DOLLARS for a total of $___________________________________US DOLLARS.

 

TERMS AND CONDITIONS:

 

PAYMENT: A deposit of 50% of total rental confirms your reservation.  The remaining 50% is due 45 days prior to arrival.  Checks should be made payable to Daniel Hartman and mailed to: 5161 San Felipe Suite 320, Houston, Texas  77056.  Complete, sign and send this form with your deposit to the address above.  After we receive final balance, an email will be sent to you with final instructions for our representative to greet you at the airport, assist in your transport, give you a welcome at our on-site Hospitality Office and show you your condo.

 

SECURITY DEPOSITS: A $500 Security Deposit will be collected at time of check in by Credit card or Cash guarantee.  The total of the deposit shall secure compliance with the terms and conditions of this agreement and shall be refunded to RESIDENT immediately after the premises have been completely vacated less any amount necessary to pay OWNER;a) remote control replacement costs b) cost for repair of damages to premises , furnishings, electronic equipment, appliances and/or common areas above ordinary wear and tear, and c) any other

Amount legally allowable under the terms for this agreement.  A written accounting of said charges shall be presented to RESIDENT immediately upon check out.  If deposits do not cover costs such costs and damages, the Tenant shall immediately pay said additional costs for damages.

 

POOL & BEACHFRONT SALT WATER SPA:  Residents are responsible for following the Rules Posted at the Pool and by the Spa for their use.  Residents use of the pool and Saltwater Spa at their own risk.  Pool Hours are 7 am to 12 pm.  Spa hours 7 am to 7 pm.  Use of the pool and spas at your own risk.  The rules posted in the pool area and spa areas must be obeyed at all times.  NO GLASS OR BOTTLES AROUND THE POOL AREA, PLEASE!!!!!!!!

 

GARAGE:  There is one parking space per Unit in the Underground Garage, please respect this and use the space marked only with your unit number.  There is a $10 deposit for the card to the garage, please return this upon checkout for a refund.  Cars parked in spaces not for their unit will be towed.  The cost of this will be $75.00.

 

NON SMOKING UNITS: It is also agreed that the building and units are designated non smoking and that smoking is only permitted on outdoor terraces. Smoking is not permitted in Hallways, Stairways, or Elevators. A fee of $250.00 will be charged upon departure if there is any evidence of smoking inside the Unit.

CANCELLATION POLICY:  Payments are refundable if the same property is re rented for the same dates at the same rate.  If we are able to re-rent your property, then you will received a full refund less a $150.00 cancellation feel.  If an emergency occurs and you must cancel, please call 954-323-8491 and every effort will be made to re-rent the property, so the refund can be made less the cancellation fee.

 

TRAVEL INSURANCE:  We strongly recommend that you consider purchasing travel insurance for your reservation.  It can protect you against many unforeseen circumstances.  You can purchase this through many companies on the web, one we use is www.accessamerica.com

 

RENTALS TO GROUPS: Any guests under 25 years of age must be accompanied by parent or legal guardian.  We will not rent to high school or collage age groups, unless they are accompanied by a legal guardian or parent.  El Cantil Condominiums, Inc., reserves the right to immediately terminate or reject rental, without a refund, if in our opinion the tenants have violated this policy or determines, in Agents sole discretion, that tenants are detrimental to the property. 

 

CHILDREN:  Children and minors are the total responsibility of the parents/adults with them---both behavior and safety.  Children must be watched—especially poolside.

LIABILITY: Owner shall not be liable for damages resulting from injury to any person or any person’s property in connection with this Rental Agreement or while on the premises. TENANTS agree (1) to indemnify and hold harmless OWNER from any liability, loss or obligation resulting from any such injuries or damages, and (2) to resolve any disputes under Mexican law.

IVA TAX AND SERVICE CHARGE: In addition to the agreed upon rental fee, TENANT must pay a 12% occupancy tax that is assessed on all rental agreements in Mexico. No service charge has been added or will be requested. Tips made to maids and other personnel are solely a matter of each guest’s discretion. If you wish to tip personnel, common practice suggests that $5 per person per week is appropriate.

LIMITATIONS/MAXIMUM OCCUPANCY: Please note the maximum occupancy of Unit 4-C Sur is 6 total persons.  Exceeding the Maximum occupancy at any time, with either overnight or day guests is not permitted without prior written approval.  Doing so violates the terms of this contract and may violate our contract with the owner and our local building codes.

Additional guests found occupying the unit will be subject to eviction or if subsequently approved, must pay in advance the daily rate calculated on a per-guest basis for that unit.

 

CONSTRUCTION: Construction of new attractions and accommodations often occurs in resort areas.  We can not make rate adjustments or refunds for inconvenience due to construction, road repairs, etc.

 

SUBSTITUTION:  Should a condo be sold or be out of order for any reasons prior to your arrival, El Cantil Condominiums Inc. reserves the right to substitute another unit equal or better without liability.  If comparable or better accommodations are not available, or tenant chooses to decline substitution, tenant will be given a full refund.

 

THINGS BEYOND OUR CONTROL: The friendly and professional staff at El Cantil works very hard to make sure your stay is perfect in every way.  There will be no refunds or discounts offered for things that are beyond our control such as construction nearby, beach access unusable due to acts of nature, condo not decorated to your taste, bad weather.  Since we are the only Condominium in Cozumel to have on-site office, most of the things that can be corrected  will be corrected in the least amount of time possible.  Examples of these types of things are breakdown of AC, TV, VCR, electronics, appliances, disturbances by neighbors, etc.

 

TIPPING: No service charge has been added or will be requested.  Tips to maids and personnel are solely a matter of discretion.  If you wish to tip, $5.00 USD per person per week is recommended.
